These Terms of Service ("Terms") govern your use of the Monk Space iOS application and getmonk.space (collectively, the "Service") operated by Monk Space ("we," "us," or "our").

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 17 years old to use Monk Space. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

2. The Service

Monk Space is a mental clarity operating system for iOS. It provides timed sessions, mood check-ins, journaling tools, and progress insights. It is not a medical device and does not provide medical advice, diagnosis, or treatment.

3. Apple App Store and EULA

If you download Monk Space from the Apple App Store, your use is also subject to Apple's Licensed Application End User License Agreement ("Apple EULA"). In the event of conflict between these Terms and the Apple EULA, the Apple EULA controls with respect to your use of the iOS app.

Apple is a third-party beneficiary of these Terms and may enforce them against you as permitted by the Apple EULA.

You acknowledge that Apple is not responsible for maintenance, support, or warranty obligations for Monk Space except as required by applicable law.

4. Pre-orders

Monk Space pre-orders open July 1, 2026, subject to App Store availability and Apple's pre-order terms. Pre-order pricing, billing date, and cancellation rules are governed by Apple. We do not control App Store pre-order mechanics.

Availability may vary by region. We may modify launch timing if required by App Store review or operational needs, and will update getmonk.space accordingly.

5. Accounts

You may sign in with Apple Sign In. You are responsible for maintaining the security of your Apple ID and device. Notify us at hello@getmonk.space if you believe your account has been compromised.

You may delete your account from in-app Settings or by contacting support.

6. Subscriptions and billing

Monk Space offers optional Pro subscriptions:

• Monthly: $9.99 per month
• Annual: $59.99 per year
• 7-day free trial on eligible Pro plans

Payment is processed by Apple. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period in your Apple subscription settings. Trial eligibility and pricing are determined by Apple and RevenueCat configuration at purchase time.

Refunds are handled by Apple under Apple's refund policies. We do not process payment card refunds directly.

Free tier features and Pro features are described on getmonk.space and in-app and may change as the product evolves.

7. Acceptable use

You agree not to:

• Use the Service for unlawful purposes
• Attempt to access another user's data
• Reverse engineer, scrape, or interfere with the Service except as permitted by law
• Upload malware or abusive content
• Misrepresent your identity or age

We may suspend or terminate access for violations.

8. Intellectual property

Monk Space, including software, design, trademarks, and content we provide, is owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

You retain ownership of content you create in the app, such as journal entries, subject to the license needed for us to operate sync and backup features you enable.

9. Health and wellness disclaimer

Monk Space is a personal clarity tool. It is not intended to diagnose, treat, cure, or prevent any disease or medical condition. It does not replace care from a qualified health professional.

If you are in crisis or need urgent help, contact local emergency services or a crisis line in your country. Do not rely on Monk Space for emergency support.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $50.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

12. Indemnification

You agree to indemnify and hold us harmless from claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service or violation of these Terms.

13. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, if required by law, or if we discontinue the Service with reasonable notice where practicable.

Sections that by nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, and governing law.

14. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country of residence apply.

15. Dispute resolution

Before filing a formal claim, contact hello@getmonk.space and allow 30 days to resolve the dispute informally.

If informal resolution fails, disputes will be resolved in the state or federal courts located in Delaware, unless applicable law requires otherwise.

16. Changes

We may update these Terms from time to time. Continued use after the effective date of revised Terms constitutes acceptance. Material changes will be posted at getmonk.space/terms.
